Privacy notice

INTRODUCTION

This Privacy and Data Protection Notice (hereinafter referred to as the "Notice") contains the rights and obligations of Attila Kiss Noel, a private individual (hereinafter referred to as the "Data Controller"), regarding the processing of personal data provided to the Data Controller during the contact process on the www.noelino.hu website (hereinafter referred to as the "Website"), and other relevant provisions.

Personal data uploaded to the Website is processed and collected in accordance with the laws of the European Union directly applicable to the Website and the provisions of the Hungarian legislation in force. In particular, the processing of personal data is governed by Act CXII of 2011 on the Right of Informational Self-Determination and Freedom of Information (hereinafter referred to as the "Information Act"), Act CVIII of 2001 on certain issues of electronic commerce services and services related to the information revolution, and the recommendations of the National Authority for Data Protection and Freedom of Information and its data protection practices.

The Data Controller shall treat the personal data received confidentially and shall take all measures necessary to ensure secure processing. The Data Protection Officer of the Controller can be contacted at dance@noelino.hu.

INTERPRETATIVE PROVISIONS

The following interpretative provisions are based on the Information Act:

personal data: data which can be associated with the data subject ('the customer'), in particular his or her name, address and one or more factors specific to his or her physical, physiological, mental, economic, cultural or social identity, and any inference that can be drawn from the data concerning the user, which is not in the public interest or in the public domain. Personal data includes, but is not limited to, name, address and e-mail address.

consent: a voluntary and explicit expression of the user's will, based on appropriate information, by which the user gives his or her unambiguous agreement to the processing of personal data concerning him or her, either in full or in relation to specific operations.

objection: a statement by the user objecting to the processing of his/her personal data and requesting the cessation of the processing or the deletion of the processed data.

controller: a natural or legal person or a company with legal personality who, alone or jointly with others, determines the purposes for which the data are to be processed, takes and implements decisions regarding the processing (including the means used) or has them implemented by a processor on its behalf.

processing: any operation or set of operations which is performed upon data, whatever the procedure used, in particular collection, recording, recording, organisation, storage, alteration, use, consultation, disclosure, transmission, alignment or combination, blocking, erasure and destruction, as well as prevention of further use, taking of photographs, sound recordings or images and recording of physical characteristics which can be used to identify a person.

On the basis of the above, the Data Controller is the controller of all data that qualify as personal data and are uploaded during registration and/or purchase on the Website.

THE PRINCIPLES OF DATA MANAGEMENT

Personal data may be used only for specific purposes, for the exercise of rights and the performance of obligations. The processing must comply with this purpose at all stages. The Controller processes the personal data recorded for the purpose of providing the service. The Data Controller shall only process personal data whose recording is necessary for the customer to be able to use the service and for the Data Controller to be able to perform the service contractually.

The Website can be visited by anyone. The Data Controller does not collect or process data on visitors. When using the service available through the Website (contacting us), the following data is mandatory:

Personal data may be processed either by law or with the consent of the user. Accordingly, by providing the above data when contacting us on the Website and by starting to use the service, the user expressly consents (i) to the use and processing of his/her personal data for the purposes set out in the paragraph "Purpose of processing" below; and (ii) to the storage of the data by the Data Controller under the conditions set out in this Policy.

PURPOSE OF DATA PROCESSING

Our Customers can provide their personal data when contacting us via the Website, by telephone or by email, in order to enable the Data Controller to send the prepared offer or order confirmation to the user, and to initiate contact in case of questions. Duration of data processing: until the purpose of data processing is achieved, or until any other time specified by law. Legal basis for processing: § 13/A of Act CVIII of 2001 on certain aspects of electronic commerce services and information society services.

DATA TRANSMISSION, DATA PROCESSING

The Data Controller shall not disclose the personal data provided during the contact to third parties without the prior consent of the user, except to the extent necessary for the purposes of the processing to a carrier or courier contractor, except in cases where the Data Controller is required to disclose the data by law.

The Controller may use the services of a data processor to process the personal data processed. The processor shall comply with the provisions of this Notice, the applicable laws in force and the contract governing its legal relationship with the Controller. There will be no transfer of personal data processed by the Data Controller.

ANONYMOUS DATA AND "COOKIES"

The Data Controller collects mostly anonymous information from the Website, such as searches. When a visitor visits the Website, the Data Controller does not collect any personal data unless the visitor authorizes it. The Controller processes anonymous information in order to improve the content of the Site. In doing so, the Data Controller may incorporate so-called "cookies" which collect the visitor's first level domain name and the date and time of access. A "cookie" is a file that is sent to the visitor's browser program and stored on the computer's hard drive. Cookies do not damage the visitor's computer. The browser program can be configured to indicate when a cookie is received and in this way the visitor can decide whether or not to accept the cookie.

An anonymous visitor identifier (cookie) is a unique set of signals that service providers place on visitors' computers to identify them and store information. It is important to note that such a sequence of signals, given that it does not store the full IP address, cannot in itself identify the customer, i.e. the visitor, in any way, but can only be used to recognise the visitor's computer. It is not necessary to provide a name, e-mail address or any other personal information, as the service provider does not ask the visitor for any data when using such solutions, the data exchange is in fact between machines.

This website uses Google Analytics, a web analytics service provided by Google Inc. ("Google"). Google Analytics uses "cookies", which are text files placed on your computer, to help the website analyze how users use the site.

The information generated by the cookie about your use of this website (including your IP address) will be transmitted to and stored by Google on servers in the United States.

Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity for website operators and providing other services relating to website activity and internet usage. Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google's behalf. Google will not associate your IP address with any other data held by Google. You may refuse the use of cookies by selecting the appropriate settings on your browser, however please note that if you do this you may not be able to use the full functionality of this website. RIGHT OF REDRESS

The Customer may request information about the processing of his/her personal data, and may request the rectification of his/her personal data or - with the exception of data processing required by law - their erasure or modification at any time by sending an e-mail to the Data Controller at dance@noelino.hu, by calling the Data Controller's telephone number, or by sending a letter to the Data Controller by post.

At the request of the customer, the Data Controller shall provide information about the data processed by the Data Controller or by any data processor it may have engaged, the purpose, legal basis and duration of the processing, the name, address (registered office) and activities of the data processor, and the persons who receive or have received the data and the purposes for which the data are received or have been received. The Controller, as data controller, shall provide the information in writing in an intelligible form within the shortest possible time from the receipt of the request, but no later than 30 calendar days. The information shall be provided free of charge if the person requesting the information has not yet submitted a request for information to the Controller in the current year in the same field. In other cases, the Data Controller may charge a fee.

The Data Controller shall delete the personal data without undue delay if (i) the registered user notifies the Data Controller in writing by sending an e-mail to the e-mail address of the Customer Service dance@noelino.hu or by sending a statement to the Data Controller by post to the Data Controller's headquarters; (ii) the processing is unlawful, (iii) the purpose of the processing has ceased, or (iv) the statutory period for storing the data has expired or has been ordered by a court or the National Authority for Data Protection and Freedom of Information.

The Data Controller shall notify the customer concerned of the rectification and deletion by e-mail, provided that the Data Controller may dispense with the notification if the legitimate interests of the user concerned are not prejudiced in view of the purpose of the processing. The customer may object to the processing of his/her personal data if the processing of the personal data is necessary solely for the purposes of the exercise of a right or legitimate interest pursued by the controller, unless the processing is required by law; the personal data is used for direct marketing, public opinion polling or scientific research; the exercise of the right to object is otherwise permitted by law.

The Data Controller shall, with the simultaneous suspension of data processing, examine the objection immediately after it has been lodged, but within 15 calendar days at the latest, and shall inform the user in writing of the outcome. If the objection is justified, the Controller shall terminate the processing. If the user concerned does not agree with the decision of the Data Controller, he/she may appeal against it - within 30 calendar days from the date of its notification - to a court or to the National Authority for Data Protection and Freedom of Information (seat: 1125 Budapest, Szilágyi Erzsébet fasor 22/C., website: http://www.naih.hu). The Data Controller may not delete the data of the user concerned if the processing is ordered by law. The data controller may take legal action against the data subject for violation of his/her rights. The court shall rule on the matter out of turn.

The Data Controller reserves the right to amend the Prospectus accordingly in the event of changes in the European Union or Hungarian legislation.

This Notice shall enter into force on 1 March 2023 and shall apply to all registered users and to users who contact the Data Controller through the Website without registration. Registered users and users who place an order on the Website without registering are obliged to comply with this Notice.
